These Terms of Service ("Terms") govern your use of the website dronesurveycr.com (the "Site") and the professional drone survey services provided by Drone Survey Costa Rica ("we," "us," or "our"). By using our Site or engaging our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Services Offered
Drone Survey Costa Rica provides professional aerial surveying services throughout Costa Rica, including but not limited to:
- LiDAR mapping: High-density point cloud generation using DJI Matrice 300 RTK with Zenmuse L1 LiDAR sensor for centimeter-accurate terrain models.
- Photogrammetry: Orthomosaic maps, 3D models, and volumetric measurements from aerial imagery.
- GPS geopositioning surveys: RTK-enabled ground control point placement and georeferencing.
- Aerial video and photography: Professional drone footage for real estate, construction documentation, marketing, and inspections.
Services are available across all provinces of Costa Rica, including San José, Alajuela, Cartago, Heredia, Guanacaste, Puntarenas, and Limón.
2. Quote and Booking Process
To request our services:
- Submit a quote request via our online form or contact us via WhatsApp or email at dronesurveycr@gmail.com.
- We will review your project requirements and respond with a detailed quote, typically within 24 hours.
- Quotes are valid for 30 days from the date of issue unless otherwise stated.
- A project is considered confirmed once you accept the quote in writing (email or WhatsApp) and any required deposit has been received.
- We will coordinate a survey date based on mutual availability and weather conditions.
3. Pricing and Payment
- All prices are quoted in United States Dollars (USD) unless otherwise agreed in writing.
- We may require a deposit of up to 50% at the time of booking, with the balance due upon delivery of final data.
- We accept the following payment methods: cryptocurrency, PayPal, bank transfer (wire or ACH), and cash.
- Invoices are issued through our Zoho Invoice client portal and are due within 7 days of delivery unless other terms are agreed.
- Late payments may incur a fee of 2% per month on the outstanding balance.
4. Cancellation and Rescheduling
- Client cancellation: If you cancel more than 48 hours before the scheduled survey date, any deposit paid will be refunded in full. Cancellations within 48 hours of the survey may forfeit the deposit to cover mobilization costs.
- Rescheduling: You may reschedule a survey at no additional cost provided you notify us at least 48 hours in advance. Rescheduling requests within 48 hours are subject to availability and may incur a rescheduling fee.
- Our cancellation: We reserve the right to cancel or reschedule a survey due to unsafe conditions, equipment issues, or regulatory restrictions. In such cases, we will offer a new date at no additional cost or provide a full refund.
5. Weather and Flight Conditions
Drone survey operations are inherently dependent on weather and environmental conditions. You acknowledge that:
- Surveys cannot be safely conducted in rain, high winds (sustained winds above 30 km/h), heavy fog, or lightning conditions.
- We will make reasonable efforts to monitor forecasts and inform you in advance if conditions are unfavorable.
- If a survey must be paused or postponed due to weather on the day of the flight, we will reschedule at no additional cost to you.
- All flights are conducted in compliance with permits issued by the Dirección General de Aviación Civil (DGAC), which may impose temporary flight restrictions in certain areas.
6. Deliverables and Timeline
- Upon completion of a survey, we will process the collected data and deliver the agreed-upon outputs (e.g., point clouds, orthomosaics, 3D models, contour maps, aerial video).
- Standard processing time is approximately 72 hours from the date of data collection, depending on project size and complexity.
- Deliverables are provided electronically via secure download link, cloud storage, or physical media as agreed.
- We will retain a copy of your project data for up to 12 months after delivery. After this period, data may be deleted. We recommend you maintain your own backup copies.
- Revision requests should be submitted within 14 days of delivery. Minor adjustments to output format or coordinate system are included at no charge. Significant reprocessing may incur additional fees.
7. Accuracy Disclaimers
While we strive for the highest level of accuracy in all our survey work:
- Survey data, maps, and models provided by Drone Survey Costa Rica are intended for reference, planning, and informational purposes.
- Our drone survey data is not a substitute for a formal cadastral survey (plano catastrado) conducted by a licensed topógrafo registered with the Colegio de Ingenieros Topógrafos de Costa Rica, where such a survey is required by law for property registration, boundary disputes, or legal proceedings.
- Accuracy is influenced by environmental factors, ground cover density (especially in tropical vegetation), atmospheric conditions, and GPS satellite geometry at the time of the survey.
- We document the expected accuracy specifications in each project quote and deliverable report.
- Clients are responsible for verifying that our deliverables meet their specific project requirements before relying on them for critical decisions.
8. Intellectual Property
- Client ownership: Upon full payment, the client receives full ownership and usage rights to all survey data, maps, models, images, and video produced for their project.
- Portfolio use: We reserve the right to use anonymized, non-confidential examples of completed work (such as sample orthomosaics or point cloud visualizations) in our portfolio, website, social media, or marketing materials. No client name, address, or identifiable property details will be disclosed without your written consent.
- Opt out: If you do not wish for any project imagery to be used in our portfolio, please notify us in writing before or at the time of booking and we will respect your request.
9. DGAC Compliance and Flight Permits
All drone operations conducted by Drone Survey Costa Rica comply with the regulations established by the Dirección General de Aviación Civil (DGAC) of Costa Rica:
- We hold valid DGAC registration and permits for commercial drone operations.
- We handle all flight permit applications and authorizations required for your project location, including restricted airspace approvals where necessary.
- All flights are conducted within visual line of sight (VLOS) or extended VLOS as permitted, with proper safety protocols.
- Any permit fees imposed by DGAC or other authorities for specific flight zones will be communicated to you in advance and, if applicable, included in the project quote.
10. Limitation of Liability
To the maximum extent permitted by Costa Rican law:
- Drone Survey Costa Rica's total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific project giving rise to the claim.
- We shall not be liable for any indirect, incidental, consequential, or special damages, including lost profits, business interruption, or loss of data, arising from or related to our services.
- We shall not be liable for delays or failures in performance caused by events beyond our reasonable control, including but not limited to weather, natural disasters, government actions, airspace restrictions, equipment failure due to force majeure, or changes in regulatory requirements.
- You agree to use our deliverables in accordance with their stated accuracy specifications and intended purpose. We are not responsible for damages resulting from misuse or misinterpretation of survey data.
11. Indemnification
You agree to indemnify and hold harmless Drone Survey Costa Rica, its employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of our deliverables, your breach of these Terms, or your violation of any applicable law.
12. Governing Law and Dispute Resolution
- These Terms are governed by and construed in accordance with the laws of the Republic of Costa Rica.
- Any dispute arising from these Terms or our services shall first be submitted to good-faith negotiation between the parties for a period of 30 days.
- If negotiation fails, disputes shall be resolved through the courts of San José, Costa Rica, which shall have exclusive jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
